Article 1 – Definitions
In these terms and conditions, the following definitions apply:
- Cooling-off period: the period within which the consumer can make use of their right of withdrawal;

Consumer: the natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the entrepreneur;
Day: calendar day; - Continuous transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;
- Durable data carrier: any medium that enables the consumer or entrepreneur to store information addressed to them personally in a way that allows future consultation and unaltered reproduction of the stored information;
- Right of withdrawal: the option for the consumer to withdraw from the distance contract within the cooling-off period;
- Entrepreneur: Rosabella The Label, the natural or legal person who offers products and/or services to consumers at a distance;
- Distance contract: a contract concluded within the framework of an organized system by the entrepreneur for the distance sale of products and/or services, whereby up to and including the conclusion of the contract, only one or more techniques for distance communication are used;
- Technique for distance communication: a means that can be used for concluding a contract, without the consumer and entrepreneur being together in the same room at the same time;

Article 2 – Identity of the entrepreneur

Article 3 – Applicability.
These general terms and conditions apply to every offer from Rosabella The Label and to every distance contract and order concluded between Rosabella The Label and the consumer.
Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated that the general terms and conditions can be inspected at Rosabella The Label and will be sent free of charge upon request.
If the distance contract is concluded electronically, the text of these general terms and conditions will be provided to the consumer in such a way that they can be easily stored on a durable data carrier. If this is not possible, it will be indicated where the conditions can be accessed electronically and that they will be sent free of charge upon request.
If, in addition to these general terms and conditions, specific product or service conditions also apply, the consumer can, in case of conflicting conditions, invoke the provision that is most favorable to them.
If a provision in these general terms and conditions is wholly or partially null and void or annulled, the agreement will otherwise remain in force. In mutual consultation, a new provision will be drawn up that approximates the original intent as much as possible.
Situations not covered by these terms and conditions or ambiguities regarding their interpretation will be assessed in the spirit of these terms and conditions.
Article 4 – The offer
If an offer has a limited validity period or is made under conditions, this will be explicitly stated.
The offer is non-binding. Rosabella The Label reserves the right to change or adjust the offer.
The offer contains a complete and accurate description of the products and/or services offered. Images are a truthful representation. Obvious errors or mistakes do not bind Rosabella The Label.
All specifications and data in the offer are indicative. Deviations do not give grounds for compensation or dissolution.
The offer clearly states:
- the price including taxes;
- any shipping costs;
- the manner in which the agreement will be concluded;
- whether or not the right of withdrawal applies;
- the method of payment, delivery, and execution;
- the period for acceptance of the offer;
- the costs of distance communication if they differ from the basic rate;
- archiving of the agreement and access thereto;
- the possibility of correcting input errors;
- available languages;
- applicable codes of conduct;
- the minimum duration in the case of continuous transactions.
Article 5 – The agreement
The agreement is concluded at the moment the consumer accepts the offer and meets the stated conditions.
If acceptance takes place electronically, Rosabella The Label will confirm receipt without delay. Until this confirmation is received, the consumer may dissolve the agreement.
In the case of electronic conclusion, appropriate security measures will be taken.
Within legal limits, Rosabella The Label may check whether the consumer can meet their payment obligations and has the right to refuse orders or attach conditions, stating reasons.
Upon delivery, the consumer will receive:
- the visiting address of Rosabella The Label;
- information about the right of withdrawal or its exclusion;
- information about warranties and service;
- the data from Article 4, unless already provided;

the conditions for termination in the case of indefinite contracts.
For continuous transactions, this applies only to the first delivery.
Every agreement is concluded subject to the availability of the products.
Article 6 – Right of withdrawal
The consumer may dissolve a contract concerning the purchase of a product within 14 days without giving reasons. This period starts on the day after receipt of the product.
During the cooling-off period, the consumer must handle the product and packaging with care. Return must be made in the original condition and packaging, if reasonably possible.
The consumer must notify Rosabella The Label within 14 days of receipt, preferably by email, of their intention to exercise the right of withdrawal. The consumer then has 14 days to return the product.
If no notification or return is made within the set terms, the purchase is final.
Article 7 – Costs in the event of withdrawal
In the event of withdrawal, the return costs are borne by the consumer.
If the consumer has already paid, the amount will be refunded within 14 days after receipt of the returned product.
Article 8 – Exclusion of the right of withdrawal
The right of withdrawal may be excluded for:
- products manufactured according to the consumer’s specifications;
- products that are personal in nature;
- products that cannot be returned due to their nature;
- perishable or aging products;
- products with a price dependent on fluctuations in financial markets;
- newspapers and magazines;
- audio/video/software with a broken seal;

hygienic products with a broken seal.
For services, exclusion may apply if:
- it concerns accommodation, transport, catering, or leisure activities on a specific date;
- delivery has begun with the consumer’s consent within the cooling-off period;

it concerns betting or lotteries.
Article 9 – The price
During the validity period of the offer, prices will not be increased, except for changes in VAT rates.
Price increases within 3 months of concluding the agreement are only allowed on the basis of legislation. After 3 months, only if agreed and the consumer can terminate.
All prices include VAT and are subject to printing and typographical errors.
Article 10 – Conformity and warranty
Rosabella The Label guarantees that products comply with the agreement, the stated specifications, and legal requirements. Any additional guarantees do not affect statutory rights.
Defects or incorrect deliveries must be reported within 14 days. Return products in original condition and packaging.
The warranty does not apply in cases of:
- self-performed repairs;
- careless use;
- damage due to government regulations.
Article 11 – Delivery and execution
Orders are handled with care. Delivery takes place at the address provided by the consumer.
Delivery within 30 days, unless otherwise agreed. In case of delay, the consumer will be informed in time and has the right to dissolve the agreement.
In case of dissolution, the paid amount will be refunded within 14 days.
If delivery is impossible, a replacement product will be offered. Return costs for this are borne by Rosabella The Label.
The risk of damage or loss lies with Rosabella The Label until delivery.
Article 12 – Continuous transactions:
duration, termination, and renewal
The consumer may terminate an indefinite contract at any time with a notice period of no more than one month.
For fixed-term contracts, termination is at the end of the term with a notice period of no more than one month.
Renewal of fixed-term contracts is not allowed, except for daily/weekly newspapers for up to 3 months with one month’s notice.
After one year, the consumer may terminate agreements longer than one year with a notice period of no more than one month.
Article 13 – Payment
Unless otherwise agreed, payment must be made within 7 working days after the start of the cooling-off period.
For services, this period starts after receipt of the confirmation.
Inaccuracies in payment details must be reported immediately.
In the event of non-payment, Rosabella The Label may charge reasonable costs.
Article 14 – Complaints procedure
Complaints must be submitted in full and clearly to Rosabella The Label within 7 days of discovery.
Complaints will be answered within 14 days. If more time is needed, the consumer will receive an acknowledgment with a deadline.
If a complaint is not resolved in consultation, a dispute arises.
A complaint does not suspend Rosabella The Label’s obligations.
If a complaint is justified, Rosabella The Label will replace or repair the product free of charge.
Article 15 – Disputes
Only Dutch law applies to agreements between Rosabella The Label and the consumer to which these general terms and conditions relate, even if the consumer resides abroad.
